CarGenie Terms of Service

You must be at least 18 years old and legally able to enter into contracts to use CarGenie. By using the service, you confirm that you meet these requirements.

CarGenie helps shoppers discover vehicles that may fit their needs, preferences, lifestyle, and budget.

CarGenie may be available:

• directly through CarGenie's website;
• through a CarGenie experience embedded on a dealership website; or
• through other participating automotive partners.

Depending on the experience, CarGenie may ask questions about things such as:

• vehicle size and passenger needs;
• cargo, towing, or driving requirements;
• vehicle features and preferences;
• powertrain and body style;
• budget or monthly payment preferences;
• general purchase timing; and
• other information used to improve vehicle recommendations.

Certain dealership versions may also ask for limited finance-related information, such as a self-reported credit range, to provide additional context to the dealership.

CarGenie recommendations are intended to help you discover vehicles that may fit what you are looking for.

Recommendations are informational only.

CarGenie does not guarantee that:

• a recommended vehicle will be available;
• vehicle information will always be complete or error-free;
• a vehicle will meet all of your needs;
• listed pricing, payments, incentives, specifications, or availability will remain unchanged; or
• you will be able to purchase or finance a particular vehicle.

You should confirm all vehicle information directly with the dealership before making a purchase decision.

When CarGenie is used on a participating dealership website, you may be asked to provide information such as your name, email address, and phone number before receiving your vehicle matches.

If you submit this information, CarGenie may provide your contact information and relevant quiz responses to that dealership so the dealership can follow up with you regarding:

• your vehicle matches;
• vehicles available in its inventory;
• your vehicle search;
• financing options; and
• related dealership services you requested or expressed interest in.

The dealership may receive additional context from your quiz, such as your vehicle preferences, payment range, purchase timeline, self-reported credit range, and vehicles recommended to you.

The participating dealership is responsible for its own communications, sales process, financing process, and handling of information within its own systems.

Some CarGenie dealership experiences may ask for limited finance-related information to help personalize the experience and give the dealership useful context.

Unless expressly stated otherwise:

• CarGenie is not a lender;
• CarGenie does not make credit approval decisions;
• CarGenie does not guarantee financing;
• a self-reported credit range is not a formal credit assessment;
• completing a CarGenie quiz does not mean that you are approved or pre-approved for credit; and
• CarGenie does not pull your credit report as part of the standard vehicle-matching experience.

Any financing offer, interest rate, payment, approval, or lending decision is determined separately by the applicable dealership, lender, or financial institution.

You agree that information you provide through CarGenie will be reasonably accurate and will not intentionally misrepresent your identity or circumstances.

Information you provide may be used to:

• generate vehicle recommendations;
• personalize your experience;
• deliver your quiz results;
• connect you with relevant dealership inventory;
• provide a participating dealership with lead and shopper context where applicable;
• operate and improve CarGenie; and
• measure how the service performs.

Our Privacy Policy explains these practices in more detail.

CarGenie may contact you when necessary to provide something you requested, such as:

• vehicle matches;
• quiz results;
• responses to inquiries; or
• other service-related communications.

If you submit your information through a dealership version of CarGenie, the participating dealership may also contact you regarding the vehicle or financing interests you submitted.

Promotional or marketing emails and texts will be handled in accordance with applicable law, including any consent or unsubscribe requirements that apply.

CarGenie does not own or sell the vehicles recommended through the service. Vehicle information may come from dealerships or other third-party data sources.

CarGenie is not responsible for:

• a dealership's inventory availability;
• changes in vehicle pricing;
• dealership fees;
• financing terms;
• incentives or rebates;
• vehicle condition;
• dealership conduct; or
• the completion or outcome of a vehicle transaction.

Any purchase, lease, financing arrangement, trade-in, or other transaction is between you and the applicable dealership or third party.

You agree not to:

• use CarGenie for unlawful or fraudulent purposes;
• knowingly provide false or misleading information;
• attempt to interfere with or disrupt the service;
• attempt to gain unauthorized access to CarGenie systems or data;
• use automated bots, scrapers, or similar tools to access the service without permission;
• reverse-engineer or attempt to extract CarGenie's proprietary recommendation logic, software, or technology; or
• copy or commercially exploit CarGenie content or technology without permission.

CarGenie's software, quiz experience, recommendation technology, branding, designs, content, and other intellectual property are owned by or licensed to CarGenie.

Except as permitted by law or authorized by CarGenie in writing, you may not reproduce, distribute, modify, reverse-engineer, sell, or commercially exploit any portion of the service.

We may update, modify, test, suspend, or discontinue parts of CarGenie from time to time.

We do not guarantee uninterrupted or error-free access to the service.

CarGenie is provided on an “as is” and “as available” basis.

To the extent permitted by applicable law, CarGenie does not make warranties regarding the accuracy, completeness, availability, reliability, or suitability of vehicle recommendations, inventory information, dealership information, or other content available through the service.

Nothing in these Terms limits rights or protections that cannot legally be excluded under applicable consumer protection or other laws.

To the extent permitted by applicable law, CarGenie will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of the service.

CarGenie is not responsible for losses resulting from:

• a vehicle purchase, lease, or financing decision;
• dealership or third-party actions;
• inaccurate or outdated inventory information;
• vehicle availability or pricing changes; or
• decisions made based on CarGenie recommendations.

Nothing in these Terms excludes liability that cannot legally be excluded.

We may restrict, suspend, or terminate access to CarGenie where reasonably necessary, including where someone misuses the service, violates these Terms, interferes with CarGenie systems, or uses the service unlawfully.

Your use of CarGenie is also subject to our Privacy Policy.

The Privacy Policy explains how CarGenie collects, uses, shares, stores, and protects personal information.

We may update these Terms from time to time as CarGenie changes.

The updated Terms will be posted on our website with a revised effective date.

Where required by law, we will provide additional notice or obtain consent for material changes.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without limiting any mandatory consumer protection rights that may apply to you based on where you live.
